Residential Conveyancing

Conveyancing is the process of transferring ownership of a legal title of land (property) from one person or entity to another.

When you’re buying or selling, GM Law will undertake your residential conveyancing on a fixed fee basis and although we provide competitive rates, we do not cut corners.

We recommend you contact us before signing the contract if you have any queries regarding the meaning, or legal consequences of any of the terms of the contract. This is particularly important when selling, because clauses in contracts can have a different legal meaning than the one you intended. We make every effort to ensure the process is followed to your maximum advantage and convenience. That’s what makes GM Law a better choice.

Commercial Conveyancing

Buying or selling commercial real estate often demands a more comprehensive legal process than residential conveyancing. We specialise in Property Law and will carefully guide you through the process. It is essential you consult us before undertaking a commercial conveyance because there are issues beyond purchase price and settlement date that should be considered when drafting the contracts. For example –
  • What are the buyers rights if a third party ( e.g tenant, body corporate, or local authority) possesses rights which are in direct competition?
  • Has the seller complied with all state an federal laws relating to retail shop leases, environmental protection, asbestos, gst.?
  • How does the sellers compliance or non compliance with state or federal law, affect the buyer?
  • Should the buyer negotiate a due diligence period to conduct enquires of special interest to both parties.

Business Conveyancing

GM Law attend to a range of important issues from contract preparation, to ensuring all necessary steps are taken to enable a valid transfer of the business assets. In drafting a contract, there are several considerations and the rights of the buyer and seller must be thoroughly outlined. For example:

  • Are staff going or staying, and if they are staying who has the responsibility for any leave or other entitlements they may possess?
  • What rights does the buyer have to satisfy themselves as to the financial viability of the lease.?
  • What obligation does the seller have to obtain the Landlord’s consent to the sale of the business?
  • What is the seller’s future exposure to the Landlord if the buyer doesn’t fulfil their obligations under the lease.

Self-managed Super Funds

If you buy or sell real estate through your DIY superannuation fund GM Law offers legal assistance at competitive rates. If your super fund will be borrowing money for the purchase (using the instalment warrant exception), GM Law will ensure the transaction complies with superannuation legislation. 

It’s also necessary for the contract to be drafted to comply with stamp duty legislation and thus avoid the need to pay additional duty.

Property Transfers

You may want to add or remove a name or transfer a property to a related third party. You may wish to do this for a number of reasons; for example, on advice that this would maximise your tax effectiveness or minimise your risk exposure.

Alternatively, it may be as a consequence of a partnership or relationship dissolution.

Whatever the reason, GM law are able to attend to your property transfer requirements.

Retirement Village Contracts

Moving into a retirement village can be a stressful time in your life. GM Law will assist with the process so you can relax and enjoy this next phase of your life.
